1. Acceptance of Terms
By accessing or using the Kovalent AI platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access the Service.
2. Description of Service
Kovalent AI provides an infrastructure orchestration platform that allows users to deploy, scale, and manage private AI nodes and large language models. The Service is provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue the Service at any time.
3. Acceptable Use Policy
The Kovalent infrastructure grants you significant computation capabilities in an isolated network. You agree not to use the Service to:
- Deploy models or agents for illegal activities, spam, or malicious generation.
- Attempt to escape container namespaces, access the underlying host OS, or attempt lateral movement within our Kubernetes or EC2 fleets.
- Abuse the Tailscale mesh network or reverse engineer our Control Plane APIs.
- Run persistent background processes unrelated to AI generation or vector database operations (e.g., cryptomining is strictly prohibited and will result in immediate termination).
- Deploy models or agents for illegal activities, spam, or malicious generation.

4. Customer Responsibility for Content
Because Kovalent implements a zero-trust architecture and has no visibility into the data traveling within your private mesh, you are fully and solely responsible for all data, files, and content processed by your AI nodes. We act merely as the infrastructure orchestration provider.
5. Intellectual Property
All graphics, logos, designs, and source code of the Kovalent AI Control Plane and Dashboard are the intellectual property of Kovalent AI or our licensors. You retain full ownership and intellectual property rights over the data, prompts, and content you process through your provisioned nodes.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Kovalent AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Kovalent AI is primarily based, without regard to its conflict of law provisions.
